Welcome to earsy! These Terms and Conditions govern your use of our personalized audio storytelling platform. By creating an account or using our services, you agree to be bound by these terms.
Please read these terms carefully before using earsy. If you do not agree with any part of these terms, you may not access or use our services.

1. Acceptance of Terms
By accessing or using earsy, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy.
These terms constitute a legally binding agreement between you and earsy. If you are using our services on behalf of an organization, you represent that you have authority to bind that organization to these terms.
You must be at least 18 years old to create an account. If you are under 18, you may only use earsy under the supervision of a parent or legal guardian who agrees to these terms.
2. Description of Services
earsy provides a personalized audio storytelling platform that allows you to:
- Browse and discover audio stories across Fiction, Factual, and Educational categories
- Generate personalized versions of stories with custom names, places, and details
- Create child profiles for family-friendly personalisation
- Download and replay generated stories
- Rate, review, and like stories
- Participate in community leaderboards
- Manage subscriptions and tale credits for story generation
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice. We are not liable for any modification, suspension, or discontinuation of services.
3. User Accounts and Registration
To access certain features of earsy, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information
- Maintain the security of your password and account credentials
- Notify us immediately of any unauthorized access or security breach
- Accept responsibility for all activities that occur under your account
- Not share your account credentials with others
- Not create multiple accounts to circumvent system limitations
We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion if we believe you have violated these terms.
4. Subscriptions and Payments
Subscription Plans
earsy offers the following subscription plans:
- Lite: £5/month for 10 tale credits. Unlimited streaming of original tales; downloading original tales costs ½ tale credit each.
- Premium: £10/month for 20 tale credits. Unlimited streaming and downloading of original tales.
- Lifetime Access: £90 one-time purchase for 240 tale credits. Permanent access to stream and download all original tales forever, including future releases.
- Credit Top-ups: £10 one-time purchase for 20 additional tale credits (£0.50 per credit). Available to all subscribers without changing your plan.
Billing and Payment
- All payments are processed securely through Stripe
- Subscriptions automatically renew at the end of each billing period
- Tale credits are granted immediately upon subscription activation
- You authorize us to charge your payment method for recurring subscription fees
- Prices are subject to change with 30 days notice to subscribers
Cancellation and Refunds
- You may cancel your subscription at any time via your profile settings
- Cancellation takes effect at the end of your current billing period
- You retain access to your subscription benefits until the period ends
- Unused tale credits are retained even after your subscription ends and can be used if you resubscribe
- Refunds are not provided for partial subscription periods or unused tale credits
- We reserve the right to issue refunds at our sole discretion
Note: Beta testing codes provide free tale credits for platform evaluation. These tale credits are subject to expiration and cannot be transferred or refunded.
5. Tale Credit System
earsy uses a tale credit system for story generation:
- Personalised Stories: 1 tale credit per generation. Once generated, personalised tales are yours to keep and download forever.
- Original Tales (Streaming): Free unlimited streaming for all subscribers.
- Original Tales (Download): Free for Premium and Lifetime members; ½ tale credit for Lite subscribers.
- New User Bonus: 3 free tale credits upon account registration.
Important Terms:
- Tale credits are non-transferable and cannot be exchanged for cash
- Tale credits never expire and are retained even if your subscription ends
- Failed generation attempts do not consume tale credits
- Personalised tales can be re-downloaded forever without additional credits
- Access to stream original tales requires an active subscription (Lite or Premium) or Lifetime membership
- We may adjust tale credit pricing with notice to existing subscribers
6. Content and Intellectual Property
Our Content
All content on earsy, including stories, audio recordings, text, graphics, logos, and software, is owned by earsy or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or create derivative works from our content without express written permission.
Your Content
When you provide personalisation information (names, places, details), you retain ownership of that information. However, you grant earsy a license to:
- Use your personalisation data to generate custom audio stories
- Store and cache generated audio for your account
- Process your data through third-party services (ElevenLabs for text-to-speech)
Generated Stories
Personalized stories you generate are licensed to you for:
- Personal use: Listen, download, and share with family and friends
- Non-commercial use: You may not sell, license, or commercially exploit generated stories
The underlying story content and voice recordings remain the property of earsy.
Copyright Notice: Unauthorized reproduction or distribution of earsy content may result in civil and criminal penalties.
7. User Conduct and Prohibited Uses
You agree not to use earsy to:
- Violate any applicable laws, regulations, or third-party rights
- Impersonate any person or entity or misrepresent your affiliation
- Transmit malicious code, viruses, or harmful software
- Attempt to gain unauthorized access to our systems or other user accounts
- Scrape, crawl, or use automated tools to access our services
- Reverse engineer, decompile, or disassemble our software
- Generate content that is illegal, harmful, threatening, abusive, or offensive
- Use our services to harass, stalk, or harm others
- Interfere with or disrupt our services or servers
- Create accounts using automated means or under false pretenses
- Resell, sublicense, or redistribute our services without authorization
We reserve the right to investigate violations and take appropriate action, including account suspension or termination, and cooperation with law enforcement.
8. Account Termination
Termination by You
You may terminate your account at any time by contacting support. Upon termination:
- Your access to earsy services will cease
- Your personal data will be deleted within 30 days
- Unused tale credits will be forfeited
- Active subscriptions will be cancelled (no prorated refunds)
Termination by Us
We may suspend or terminate your account immediately without notice if:
- You violate these Terms and Conditions
- Your account is used for fraudulent or illegal activities
- We are required to do so by law
- Continued provision of services poses a security or legal risk
Effect of Termination
Termination does not affect provisions that should survive, including intellectual property rights, disclaimers, indemnification, and limitation of liability.
9. Disclaimers and Warranties
EARSY SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:
- Warranties of merchantability and fitness for a particular purpose
- Warranties that services will be uninterrupted, secure, or error-free
- Warranties regarding accuracy, reliability, or quality of content
- Warranties that defects will be corrected
We do not warrant that our services will meet your requirements or expectations. You use earsy at your own risk. We are not responsible for content suitability, age-appropriateness, or educational value.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EARSY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
This includes, but is not limited to:
- Loss of profits, revenue, data, or business opportunities
- Service interruptions or system failures
- Unauthorized access to your account or data
- Errors or inaccuracies in content
- Third-party conduct or content
- Deletion or corruption of user-generated stories
Our total liability for any claims arising from your use of earsy shall not exceed the amount you paid to us in the 12 months preceding the claim, or £100, whichever is greater.
Some jurisdictions do not allow limitation of liability for incidental or consequential damages, so some limitations may not apply to you.
11. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
Any disputes arising from these terms or your use of earsy shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
12. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. When we make changes, we will:
- Update the "Last Updated" date at the top of this page
- Notify you via email for material changes
- Provide notice on our platform for significant updates
Your continued use of earsy after changes take effect constitutes acceptance of the modified terms. If you do not agree to the changes, you must stop using our services and cancel your account.
It is your responsibility to review these terms periodically. We recommend checking this page regularly for updates.
